Traditional beadwork designs

What do you think about beaders who copy and incorporate traditional family and tribal designs into their creations and sell them when they are not of that tribe or family?

So is it better if they are of that tribe or family ? They are still selling them.
Does it matter if they sell them , or give them away to friends that may not be in the same tribe ?

As a beader and a Southern Cheyenne , I try not to copy designs. I make up designs , put them on the items I make. If they happen to be similar to someone elses designs well , there are only so many ways to make a mountain design or other geometric shapes. Even the tipi door design that my Grandmother used alot , has been changed and put on tons of different things.
Take the exact same design and change 1 color , is it the same ?
Only so many designs and so many colors.
That's my opinion , anyway.

I agree with wardancer-there are only so many ways you can change a design. People will copy designs. It's easy now with the internet giving everybody access to everything. Unless it's something copyrighted-and you can't copyright a shape-there's nothing you can do. It's up to the person who was copied to step in and say "don't do that". IMHO, people who copy are people who can't create on their own.

So you both are saying since it can't be helped or successfully altered, it is okay to sell it because the internet allows people to copy and people are going to make and sell it anyway?

Essentially , yes , that's what my opinion is. I don't think I've ever seen 2 designs belonging to 2 different people , that were identical. But , with that said , the resources available in this age , I could see it happening. Personally , I have never copied a design to sell or give away.
I think that Native peoples have given away so much , and the dominate culture has taken so much , that it would be a futile effort to try to claim a design as "yours" ! There is an enormous amount of non-natives doing beadwork and native crafts. How could anyone believe they could be stopped ? We , as Native craftsmen , must strive to make our work better quality and more authentic in order to compete with these copycat craftsmen.
Now , these are just my opinions ! This and $1.29 will get you a cup of coffee at Quicktrip , in some areas ! LOL

To a point, yes, that's what I'm saying. Is it right-I don't think so, but I see 2 choices. You can either learn to live with it-as a lot of jewelry designers have done in the last few years, or, you can keep an attorney on a retainer, so they can be ready to send out cease and desist letters at a moments notice.

I monitor the venue I sell on for people who are selling "Native American". If they don't check out, I do notify the venue admin. that the seller could be violating the NA Craft Act. That's pretty much all I can do as one person.
