This is very interesting......NC is one of the states that offers Alienation of Affection as a cause for divorce. You can actually sue someone if you can prove they have had or been involved in an adulturous affair while you were still married...thought you would like to read about it too.

LUMBERTON - A Bladen County man was awarded more than $500,000 in an alienation of affection civil lawsuit against a Robeson County anesthesiologist.

Michael Kinlaw filed the lawsuit in February 2003 against Dr. John Harris. In the suit, Kinlaw alleges that Harris coerced his wife into having an affair.

On Wednesday, a Robeson County Superior Court jury sided with Kinlaw. It awarded him $400,000 in punitive damages and $100,000 as a result of "malicious and wrongful conduct'' by Harris, according to court records. The jury also awarded him $67,000 based on an adultery allegation.

Kinlaw and his lawyer, Steven Lawrence, could not be reached for comment.

Jeffrey Rogers, Harris' lawyer, said Thursday that both parties are happy the ordeal is over.

"We certainly weren't pleased with the verdict, but we are pleased the amount was not larger," Rogers said. "…Other juries in other parts of the state have returned and awarded a million dollars plus on a case like this."

Kinlaw and his wife, Debra Holt Kinlaw, eventually divorced after almost 10 years of marriage.


Hospital meetings

According to the lawsuit, Harris and Debra Kinlaw both worked at Southeastern Regional Medical Center. She was a nurse in the labor and delivery unit.

The two began their affair in 1999. The affair took place at the hospital while both were on duty and away from work, the lawsuit said.

Debra Kinlaw became pregnant by Harris and in July 2000 gave birth to a son. The two concealed the fact that the baby was not Michael Kinlaw's biological son, according to court records. In May 2002, Debra Kinlaw confessed that she had been having an affair with Harris. She also revealed that her husband was not her son's biological father.

The lawsuit said Kinlaw persuaded his wife to pursue marriage counseling. She refused to follow requests made by Kinlaw and recommendations from the marriage counselor to help reconcile their marriage, the lawsuit said. She continued to work at Southeastern Regional Medical Center even though her husband asked her to resign.

Debra Kinlaw and Harris continued their affair, and Harris "continued to encourage Debra to alienate herself from her husband, and to sever her marital relationship,'' according to the lawsuit.

Kinlaw sought damages based on adultery and alienation of affection. He also sought compensation for costs incurred for prenatal care, labor and delivery, and associated costs with raising Harris' child. He also sought punitive damages.

Rogers said he believes this is the first alienation case tried in Robeson County court.

"Being that this was the first case here, there was no way to measure what the outcome would be,'' Rogers said.

So am I getting this right? His wife cheated and got pregnant by the other guy.. so he sued the other guy and got alot of money and is gonna stick with his cheating wife and raise the other guys kid?

No he divorced her he sued for all the money he spent on the kid and such and for damages

WOW! This is interesting stuff. I am left to wonder, though, should the courts be ruling on morality issues? :dontknow:

AND I'm also left to wonder what led the woman to cheating on her husband? Perhaps nothing--perhaps she is just that way. But what if there were troubles before? Or what about a case where, say, one partner was abusive to the other, but the abused was afraid to leave the relationship for whatever reasons?

This has really left me with a lot of questions regarding this specific situation, and the whole idea of courts ruling in such matters. Though, I guess this would serve as a MAJOR deterrent to extramarital affairs.
