Canada and The AFN - The Crown and First Nations Meeting in Ottawa - Jan 24

It's an ambitious agenda but the chiefs and delegates from the Assembly of First Nations hope to cover more than just bread and butter issues with the Federal Government when they meet later this month in Ottawa.

The AFN hopes to televise the proceedings and that Canadians will be able to understand the issues facing FN communities and their people.

The preliminary agenda hopes to cover in three concurrent sessions with government decision makers:

Strengthening the Relationship and Enabling Opportunities (treaties, rights, governance, jurisdiction, title, etc.).

Unlocking the Potential of First Nation Economies (economic development, partnerships, land issues).

Realizing the Promise of First Nations Peoples (education, health, safe and secure communities, etc.).

Issues will also be on the table are the North Gateway Pipeline, Schools, Oil and Minerals rights (especially in Treaty 8 area), self-government and health.

Reform of the comprehensive land claims policy also has the support of B.C. First Nations, for whom treaty negotiations and governance will be key issues at next week's meeting, according to B.C. Regional Chief Jody Wilson-Raybould.

B.C. First Nations have made some significant strides in the area of self-government in part because the province set up an independent treaty commission to oversee the negotiation of tripartite agreements between B.C., First Nations and Ottawa.

Still, negotiations take years. Since B.C.'s treaty process was established in 1992, only the Tsawwassen First Nation and the Maa-nulth First Nations have completed the required six stages parties must go through to become self-governing (although other nations, like the Nisga'a, have negotiated agreements outside the treaty process). Three other First Nations are close to completing the process, but another 55 groups are still winding their way through lengthy and often contentious negotiations.

Wilson-Raybould would like to see the federal government provide more support to First Nations that want to break free of the constraints of the Indian Act and assume greater control over their own affairs — whether it be in the form of full autonomy or control over certain "governance sectors," such as land management or education.

"Our communities are looking to the federal government to work with us to develop a mechanism wherein when our communities are ready — when they’ve established … their own constitutions supported by our citizens — that they are able to move beyond the Indian Act to be able to, like every other Canadian, have the ability and the right to make decisions for themselves and to not have decisions made for communities by bureaucrats that aren't invested, necessarily, in the community and live 3,000 miles away."
This is a monumental meeting in that for the first time in Canadian history all our chiefs will have a face-to-face with our Prime Minister.

Let's hope that they get their points across and taken seriously.

The Meeting has begun in Ottawa, the Prime Minister has spoken to the assembly and says it's time to reset the relationship between Canada and First Nations.

Sean Atleo addresses the assembly by speaking of the urgent need to change, how the AAND tie their hands with red tape and removes the ability to react to emergencies.

He quotes elders and with references to the wapum belts with, "Our relationship is a silver chain and we must keep it bright, strong and shiny. When it tarnishes, dulls or breaks, we must repair it."

He addressed the 800 land claims that the GOC have only resolved 30 of them. He spoke of the need to rethink the Indian Act has it's the culprit of FN not being able to move forward.

Prime Minister has kept it safe by keeping the address to do more for economic development and programs.

The chiefs want to see more discussion on a nation to nation level. The treaties were signed with Great Britain (pre-confederation) and Canada. They want to see more on the push to reset the relationship between the Crown and FN. More control over mineral and resources on the land those treaties affect. They don't want to see third party control or access to those resources without consultation and economic restitution to the FN.

The Chiefs are pushing for a recognition that FNs along with the French and English were the founders of Canada - together. We need to be in a partnership not a subordinate position.

We are expecting a proposal that the GOC set aside ridings and parliamentary seat that are specific to First Nations.

Ohh.. slams the FN for keeping Indian Time...consoles the people of Burn's Lake and the sawmill explosion over the weekend.

I speak here for the treaties, that is my purpose. The treaties should govern the relationship with Canada not the Indian Act.

He asked an elder, what he should do about the Indian Act, the elder said... Act Indian not Indian Act.

The IA stands in the way of being an Indian, it's an obstacle. The treaties should be an instrument for economics and not piecemeal of programs. The treaties should not be in the archives of Canada but used to govern how we deal with each other.

We have waited a long time to have our treaties to be observed and enforced.

We need to implement our treaties in the spirit they were intended.

Our way out of poverty is to implement the pre-confederation treaties and the numbered treaties of Canada.

"To repair the relationship needs Canada to acknowledge that the wealth of the country is because of the one-sided interpretation of the treaties.

"In 1982, Lord Denning heard the chiefs in London. There is nothing so far as I can see to warrant any distrust of the Indian towards the GOC, but in case there is, a discussion is needed, to prevent an onslaught that their treaties have been preserved...The treaties need to be upheld as long as the rivers flow..."

Our constitution sets out to uphold our treaty and Aboriginal rights. We should not depend on the Supreme Court to uphold those rights, we should be at a Nation-to nation level.

We want to trust Canada, but should we? We are patient but we say to Canada, it's time to act.

The Governor General said, "When trust is strong, many things are possible."

"Mr PM, we intend as a people to insure our treaties are upheld and we ask you to implement these treaties."

"We have considered going back to the UK to remind them what Queen Victoria promised our people."

"If the treaties are understood they will give us a treaty based economy, not the Indian Act or the Land Management Act."

The governing rights flow from sovereign rights of a nations. Canada signed the UN declaration and supports it.

UN declaration, Indigenous have the rights to self government.

Canada must take measures to implement self government and determination.

Self government is not about the transfer of programs and services, it is about the management of resources of their traditional lands.

Self government without control of our resources is an empty phrase.

Speaking to provinces are the concerns of many first nations as they fear it undermines the federal relationship. The Quebec Cree have implemented school boards, health and resources with the province.

Provinces continue to make agreements with non-native municipalities that include Native land without consultation or agreement with FN communities.

The GOC insists treating FN as the same from coast to coast, they need to acknowledge the uniqueness of each FN and their specific needs.

Some words that should raise a big hmmm...

The PM has used the word Creative in the context of addressing the need to change the Indian Act. Is a creative approach something you want to see with tinkering with the Indian Act?

Program is another word being tossed around... should we be satisfied to manage and administer programs developed by Ottawa or should we expect something more toothy?

My sister just called and told me that the government offered a telecommunication service so that all the chiefs who couldn't physically be in the room can hear and participate in the talks. The bill for the telecommunications were never paid by the government and talks have stopped.

Peter Penashue addresses the meeting for closing remarks by the GOC.

He has heard that the Indian Act needs to be addressed.

Prime Minister Harper is in attendance, he was originally scheduled to attend for only half a day. The FN delegates were not impressed that he was leaving early. I'm glad to see he stayed.

"Partnerships are the best way to do business."

"We see all FN persons as a part of Canada's everlasting endurance."

"International demands for our resources have never been greater, much of these resources are on or located near FN communities. We must involve FN in the development of these resources."

"The land claim process will prove to increase a land base for FN to develop. We must break down the barriers that face FNs."

"Today we have examined our shared past and now must work towards our shared futures."


I love hearing our leaders speaking their languages... the fact that there is no offical translation services speaks volumes to how our languages are not considered important enough to have speakers presents to translate. No ticker tape at the bottom of the screens.

Sean Atleo is now speaking.

"Perhaps standing a little taller today, thank you for that."

"Today was an important day as to renewing the call to restart the relationships between FN and the GOC."

"A relationship based on partnership and based as trust."

"The Indian Act has to be moved beyond, we will work with Canada to deal with the Act. The FN have the answers and solutions, we must drive the process ourselves. We will arrive at a day that the Indian Act will be obsolete."

Tla-o-qui-aht First Nation Elder Marty Williams to conduct the closing prayer.

He asks that no matter where we go after today to remember to tell the story of what happened today to our children and our grand children. Tomorrow is a new day for all our people.

I realized after posting my reply that it was posted in haste and I felt bad for a half of a second. The fact that our languages are not important enough to have translated also speaks volumes to me. This saddens me as I witness the lack of respect to all who have come from far away to speak for their people and communities.

Stephen Harper was wise to have not left the meeting early.

I will stop being negative Nancy now and try to find the positive. A lot of our Leaders were heard today and I think it is so important that the dominant population hear the lived truths and realities, not just what is represented in the media.
