Six Nations. A caravan will leave Buffalo-Niagara at 8:00 a.m- please rsvp by

PLEASE COME TO HEAR AN IMPORTANT TREATY RIGHTS CASE

On Thursday, April 28, 2005 at 2:00 p.m., the New York State Court of Appeals
in Albany will hear arguments in a treaty fishing rights case that has
important implications for all citizens of the Six Nations. The issue in the case
involves the ability of the State of New York to enforce its fishing
regulations against members of the Six Nations who are fishing pursuant to rights
guaranteed by the 1794 Treaty of Canandaigua.

The case involves the attempted enforcement by the NYS Department of
Environmental Conservation of a fishing regulation against Neil Patterson Jr., a
citizen of the Tuscarora Nation. Neil was fishing in Wilson Tuscarora State Park as
is his right under the terms of the Treaty of Canandaigua. In violation of
Neil's treaty rights, DEC ticketed Neil for failing to have his name and
address on his ice-fishing equipment.

We are trying to have the Court of Appeals, New York's highest court, reverse
Neil's conviction on the ground that, because he was exercising a treaty
fishing right, the State had to prove the "conservation necessity" of the
regulation.

YOUR ATTENDANCE AT THE HEARING WILL MAKE A DIFFERENCE! Our lawyers tell us
that if a lot of Six Nations citizens show up for the argument, the Court will
understand the importance of this issue to our people. Help make a
difference, and show the Court of Appeals that we have not forgotten the 1794 Treaty of
Canandaigua.

We are planning leave by caravan from the Buffalo-Niagara Area at 8 AM on
Thursday, April 28 for Albany. The Courthouse is located on 20 Eagle St., down
the hill from the State Capitol Building. Many will be traveling to Akwesasne
the following day for a Haudenosaunee seed meeting. Please RSVP by April 22,

I'm not six nations, but treaty law affects us all. If I can get time off I'll see what I can do. If we all start standing up for eash other, not just our own tribes, we can effect change. we can make things better for us all.
