Beating allegations lawsuit dismissed

A lawsuit by a man who says he was headed to his home at Kenel on the Standing Rock Reservation when he was severely beaten by an off-duty jail guard has been dismissed by the 8th U.S. Circuit Court of Appeals.
The decision, issued July 28, upheld an earlier ruling by U.S. District Judge Charles Kornmann. Kornmann had ruled that Bobby L. Johnson could not sue the federal government for an alleged beating by Bureau of Indian Affairs correctional officer Shobe Little Light.

That's crazy. Am I correct in assuming that after I read the article, these 2 guys were drinking together when he was assaulted?
