    The ousted chairman of the Crow Creek Sioux tribe in South Dakota is questioning the legitimacy of the April election.

    Chairman Brandon Sazue Sr. was defeated by former chairman Duane Big Eagle Sr. by 11 votes.

        Crow Creek tribal chairman indicted

        FORT THOMPSON — The Crow Creek Sioux tribal chairman was indicted Wednesday on federal charges of conspiracy and bribery for allegedly taking money intended to ensure certain contractors would rebuild the Crow Creek Tribal School after a 2005 fire.
        Duane Big Eagle, whose age was listed as 60 in April, faces two counts of conspiracy to commit bribery of a tribal official and two counts of bribery involving a tribal government agent.

        FORT THOMPSON — The Crow Creek Sioux tribal chairman was indicted Wednesday on federal charges of conspiracy and bribery for allegedly taking money intended to ensure certain contractors would rebuild the Crow Creek Tribal School after a 2005 fire.


        Duane Big Eagle, whose age was listed as 60 in April, faces two counts of conspiracy to commit bribery of a tribal official and two counts of bribery involving a tribal government agent.


        Big Eagle, who resides at Fort Thompson and also serves on the tribal school board, is accused of receiving cash from former tribal school superintendent Scott Raue between July 2005 and December 2005 for facilitating payments on the school construction project, according to an Oct. 6 complaint filed by Anthony Hoben of the U.S. Interior Department Inspector General’s office in Rapid City. Highmore contractor Royal Kutz made thousands of dollars in payments to Raue and some payments to Big Eagle as part of the conspiracy, court documents say.


        Raue was among seven people who were charged in 2008 in a money laundering scheme at the tribal school, according to The Associated Press. The case involved kickbacks and money laundering as contractors sought work for rebuilding the school’s dormitory and kitchen.


        Raue was sentenced to 10 years in federal prison in July 2009 for bribery.


        Big Eagle also is accused of conspiring to accept cash between May 2008 and October 2008 and taking that money, according to the indictment.


        Fort Pierre contractor Archie Baumann planned to give kickbacks to Raue, Big Eagle and his fellow tribal council and tribal school board members, Norman Thompson Sr. and Randy Shields, as a reward for approving loan agreements and a construction contract for work at the school, according to court documents.


        Thompson and Shields received 50-month and 40-month sentences, respectively, last June, while Baumann will be sentenced Nov. 8.


        Big Eagle pleaded not guilty to the charges Wednesday afternoon in U.S. District Court in Pierre, said Jessica Fehr, an assistant U.S. attorney in Montana.


        The Montana U.S. attorney’s office was asked to prosecute Big Eagle’s case after the South Dakota U.S. attorney’s office recused itself, Fehr said. South Dakota U.S. Attorney Brendan Johnson said his office has a conflict with the case, but he declined to elaborate.


        Big Eagle defeated incumbent Brandon Sazue to become tribal chairman in April.


        After the election, Sazue made allegations of vote-buying and other election-law violations against Big Eagle, who previously served as tribal chairman for nearly two decades.


        Big Eagle was brought to the Hughes County Jail Tuesday afternoon by federal authorities, said Bill Dodge, Hughes County Jail administrator.


        Wilfred Keeble, tribal council vice chairman, said the court system provides that one is innocent until proven guilty.


        “The tribe is in enough trouble,” he told The Daily Republic. “We’ll wait and see what happens and go from there.”


        Peter Lengkeek, tribal council member, said he received calls Wednesday from tribal members asking for Big Eagle to be removed from the council.


        A petition is being circulated among residents to remove Big Eagle from office, and that would require at least 300 signatures, Lengkeek said. The council could either vote to remove Big Eagle or the people could do so with the petition, he said.


        Big Eagle was released Tuesday on a personal recognizance bond, and his next court appearance has yet to be set, Fehr said.

          Many Thanks' to the "FBI", the 'human whistle blower' and to the departed spirits of our ancestors since the reservation era.
          This is a Great Day for the Crow Creek Reserve. ( tribe ).

          The seriousness of these charges; is that Duane Big Eagle Sr. is a suspected Whiteman who refuses to 'allow' the people of Crow Creek a blood sample,, for nearly 'Two Decades'.
          Maybe now that Duane Big Eagle Sr. is being brought up on Federal Charges, 'Maybe Now' we can finally find out who this man really is?.

          other seriousness' of these charges; is that Duane Big Eagle Sr. Is using tribal funds to buy votes, bribes, land, and 'Thugs' resulting in dividing the people of Crow Creek... In which case, the children and the enrolled members lose and have lost more then Duane Big Eagle Sr. could ever take from them ,,,, maybe it's time to reinstate true native leadership.

          Maybe this will encourage the young men and the council members to stand up and fight for the rights of their children, their elders and for the future of their Homes.

          ( All they have to do is "Act" Now )

              I find it unbelievably interesting that he, a suspected Non-Native, can deny the people's requested 'Blood Test' for years with the legal help of the BIA and the Federal Courts,
              yet, for years, he could claim and misspend the Peoples money freely , , much of it for his own , , , , purposes.

              There must be a 'legal' route that can be used to reinstate Blood Degrees to the Tribal Council.
              or, to enforce the Blood Degree laws already in place on the Tribal council.

              otherwise, as it looks now, ,
              A Non-Native can, and; 'Is' using Tribal Sovereignty to protect himself , , from the people of the tribe, of which, he is the 'Tribal Chairman' of.

              ( just a thought, , "I read some of the past responses from the Crow Creek members in the Capital Pierre News Journal on the sentencing of the other's,
              much of the responses were directed at the elders, Not standing up for the people, , , .

              I think it is the other way around, , the young people not standing up for and behind their elders." )

                The Big Eagles have every base covered. They own a liquor store and bar. Those are some good vote buying skills. We are still waiting for Rocky Fallis and Donny McGhee to make their mistakes.

                  It's too bad a ''petition of 300'' couldn't realistically remove someone from council.
                  that way, you wouldn't have to wait for them to 'make their mistakes' at all,
                  a 'petition of 300' is publicly stated to be able to have someone removed. ? (really? : )

                  a stronger statement would be for the tribal council to take a public stand in this and just vote to have him removed.
                  ( it seems the FBI would be behind them on this one )

                  a suspected non-native tribal chairman getting more protection than the people he's taking from.
                  that’s an 1868 "Bad Whiteman" Article Treaty violation.

                  I vote to have the Blood Quantum Laws reinstated or protected,
                  this is a very valuable lesson.

                  I don't know if this issue falls under 'Traditional Instructions', , but I once heard, , "Traditionally, no one person is more important than that of the tribe as a whole".
                  ( This still sounds like good common sense to me, even in today's times.).

                  Have you noticed that Duane's reign of terror has lasted for many years, a huge tribal debt.
                  everyone knew or heard of the misuse of funds, but the people and their organizations were never able to bring these people into the courts, despite countless investigations,
                  many people complained, but nothing was able to be done, , , Than in came the FBI, in just a short time they closed down the good ole boys modern day 'Indian ring",

                  All the while, the BIA Acts, Pretends they can't step in to help any where anytime over the years.

                    Duane's reign of terror started when he was adopted and word was out that he was instrumental in the land that belonged to grandmother Bliss. They were just waiting for her death.

                      I understand your families feelings for your loss of Lands.

                      My mothers families lands were illegally confiscated and than illegally dealt away, between the Tribe and the BIA.

                      I encourage, advocate, for reinstating Blood Degrees on all Land Transactions as well.

                      For the past many years, much of the Tribal corruption that has been dividing the people of Crow Creek has been during Duane's reign of terror.

                      For years and years, I have heard of people complaining about the Constitution and By-laws, others were saying they were up-dating the Constitutions and By-laws, , but they are still a main problem factor, or used as an 'excuse or a reason' to explain away political issues that seem to have only taken the tribe further into debt.


                      Maybe there will always continue to be corruption on the reservations, Unless there are harsh consequences' by the Laws of the Tribe and Federal,

                      To help get the reservation back on their feet, I hope the Crow Creek Council can find away to bring in more ''Jobs'' for the people.
                      and; also,

                      as the Vice-Chairman stated, , ( New Hunkpati Chairman?) , " we'll have to see what happens and go from there ".

                      He knows the Tribal council need's to act on this.
