    Profit is not the big issue, I'm more interested in the publishing rights. I don't want to offend anyone or be liable. It's really a matter of respect.

    And Singerdad, I've heard the same thing about taking photos of groups. But what if it is a person in the group activity, but it is just a photo of 1 person such as the example I used on the Photo site:


    I know that alot of Pow Wow photos are published without anyone ever knowing or giving permissions and I know that isn't the best idea. In our local Roadhouse grill there is a whole wall with a portrait painted of Marty Pinecose. I doubt he knows about it!

    Photos are touchy subjects. I try to protect the ones uploaded here by stamping our watermark on them. But you'll still see them on sites being used.

    I even found a elementary school one time that had downloaded the entire PowWows.com (before the forum) and was running the pages off of thier server so they could view the photos.

    Anyways, thanks everyone for the help! I really want to find the definitive answer, but I'm afraid like with most things, there just isn't a black and white answer--it's very gray!

    Thanks for trying to help answer my question. Yes that is a question I've been trying to find the answer for.

    My idea is to have a book (probably in electronic format) of photos I take at events. I get a lot of requests for people to download them and see them in high resolution. This could be one way to do that.

    One of my questions is that if it is a group photo, such as:


    Who's permission do I need to get before I publish it? Gathering? The drum? The different Gourd Socieites? Or no one?

    So thanks for bringing this up here, I appreciate the help!

    I've seen it done a couple of ways. When I was at Oglala Nation, Iowa City and Chicago someone made and annoucement like .......so and so is here from blah blah and will be taking photos all weekend for blah blah project.... anyone wishing not to be included in this please some see the the mc or whoever.

    I've then seen where the person taking photos came and gave my daughter a paper to sign and saying if her photo won (it was a contest) that he would send her an enlarged copy and copy of publication.

    I'd suggest consulting a media-law attorney for a detailed opinion on this before embarking on a project of this magnitude.

    That said, it has always been my understanding that photos taken of a group in a public setting are fair game to be published in a book, newspaper, magazine, etc. without having to garner the subject's permission. Individual photos usually require some sort of permission (verbal or written).
